Carlos Javier offers you access to this website and the use of his services based strictly on the terms set forth in these Terms and Conditions of Use. By visiting the Site, using the Site, registering into the Site, registering in the appointment program through the Site (if registration is permitted), logging in or logging out of the Site, and/or making any purchases through the Site (individually and collectively, the "Service") you are accepting and agreeing to be bound by each of the terms set forth in these Terms. 

Carlos Javier may modify these Terms at any time. Amended terms are effective upon being posted. You should, therefore, review these Terms from time to time. Your access and use of the Site or the Service after the effective date of amended Terms means that you have accepted the amended Terms. If you do not agree to be bound by (or cannot comply with) the Terms as amended, you agree that your sole remedy is to cease using the Service. Your continued use of the Service constitutes your agreement to be bound by the amended Terms. You may only use the Service in accordance with these Terms, as well as any additional terms that may be presented in connection with any particular feature or function of the Service from time to time. The Service is solely for personal non-commercial use as limited by these Terms. 

If you do not agree to be bound by (or cannot comply with) any of the terms and conditions of these Terms, do not continue to use the Service by clicking on "CANCEL" (as applicable) and/or leaving the Site. 

1. SESSION FEE. Due in full at the time of booking in order to secure your date. Session fees must be paid no later than two weeks prior to your session or it is subject to cancellation. Reserved dates are subject to being moved if another client is interested in the date and pays for their session first. I try to make sure everyone gets their desired date, but paying for your session as soon as possible helps ensure that.

Any service with the default price will require immediate payment through PayPal.

Once your session without default price is booked, you'll be contacted by us to talk about the details of the service and you'll receive an email and/or text with money request to pay for the service/s. Payments are accepted via Google Pay, PayPal or Ath Movil (Puerto Rico). Once the session fee is paid, no additional client can be booked for that time.

2. CANCELLATION. If you must cancel your session, please do so 48 hours prior to receive a full refund, otherwise, 10% fee of the total price will be charged. If you wish to reschedule, notify us during the same week or as soon as possible so we can reschedule your session to the next available date and provide this time for another client. *This is applicable only in the case of non-weather related, non-emergency postponements.

3. INCLEMENT WEATHER. We will simply reschedule your session to the next available date! A suitable indoor location can also be arranged.

4. TIME. Please arrive on time for your session dressed and ready to begin or according to the details discussed previously. There is a window of time allotted for your photo session that begins at your specified time so additional time for preparation will reduce the time we can spend taking photos. If you are more than a 1 hour late, this will result in a $30.00 fee.

5. PHOTO SESSION. Cameras of any kind are not permitted at our photo sessions.

6. ATTENDANCE. Attendance at photo sessions is limited to those being photographed. No more than 1 additional person will be allowed at the photo session. Having additional people present can be distracting to both the photographer and to those being photographed.

7. PRODUCTS. Photos will be posted on an online gallery where the client can select their favorites, write suggestions, and download photos into other devices.

8. COPYRIGHT. All images provided by Carlos Javier, whether digital or print, may not be reproduced by any means. This includes screenshots of proofs. Doing so constitutes copyright infringement and is punishable by law. 

9. NON-COMMERCIAL USE. Carlos Javier’s photos are strictly available for editorial purposes. Special contracts with professional photographers and/or model releases are required for any photo intended for commercial.

 10. USE OF PHOTOGRAPHS. Never alter the content or meaning of a photograph. In order to protect the identity of vulnerable populations at risk of reprisal, violence, or rejection in their communities as a result of telling their story, it may be appropriate to leave out detailed information about the content of the photo. Due regard must be given to the individual rights and privacy of photo subjects, basic tenets of human dignity must be observed. In all photos and social media posts regarding my work my website and myself must be credited. 

Carlos Javier le ofrece acceso a este Sitio Web y sus servicios condicionado al estricto cumplimiento de las disposiciones expuestas en este acuerdo sobre los Términos de Uso. Al utilizar el Sitio Web y/o solicitar algún Servicio usted acepta y voluntariamente se obliga a quedar vinculado por los Términos. Carlos Javier puede hacer enmiendas a estos Términos en cualquier momento. Las enmiendas realizadas a los Términos entrarán en vigor desde la fecha en que dichas se encuentren disponibles en el Sitio Web; por lo tanto, a tales efectos, usted debe revisar estos Términos de tiempo en tiempo. El que usted acceda y use el Sitio Web y/o los Servicios, luego de la vigencia de enmiendas a los Términos será interpretado como su aceptación y consentimiento a quedar vinculado por los Términos, según enmendados. De usted no consentir o de no poder cumplir con los Términos, según enmendados, usted acepta que solamente tendrá a su disposición como único remedio el desistir de continuar haciendo uso de los Servicios. De lo contrario, tal como se señaló anteriormente, si usted continúa utilizando los Servicios habrá expresado su consentimiento a continuar obligado por las disposiciones de los Términos, según enmendados.

Sólo puede hacer uso de los Servicios si cumple con los Términos, y con cualquier otro término, que de tiempo en tiempo, sea añadido referente a cualquier función particular de los Servicios. Los Servicios son sólo para el uso personal y no comercial, según tal uso es limitado por estos Términos.

Si usted no consiente y no está de acuerdo (o no puede cumplir) con estos Términos, desista de utilizar el Servicio haciendo un "click" en el botón electrónico que lee "CANCELAR" y abandone el Sitio Web.

1. TARIFA DE SESIÓN. Pago en su totalidad en el momento de la reserva para asegurar su fecha. Las tarifas de sesión se deben pagar a más tardar dos semanas antes de su sesión o están sujetas a cancelación. Las fechas reservadas están sujetas a ser cambiadas si otro cliente está interesado en la fecha y paga primero su sesión. Intento asegurarme de que todos obtengan la fecha deseada, pero pagar su sesión lo más pronto posible ayuda a garantizarlo.

Todo servicio con el precio predeterminado requerirá pago inmediato a través de PayPal. 

Una vez que se haya reservado su sesión sin el precio predeterminado, nos pondremos en contacto con usted para hablar sobre los detalles del servicio y recibirá un correo electrónico o un mensaje de texto con la solicitud de dinero para pagar el / los servicio / s. Los pagos se aceptan a través de Google Pay, PayPal o Ath Móvil (Puerto Rico). Una vez que se paga la tarifa de la sesión, no se podrá reservar ningún cliente adicional para ese momento.

2. CANCELACIÓN. Si debe cancelar su sesión, hágalo 48 horas antes para obtener un reembolso completo, de lo contrario se le cobrará un 10% de la totalidad del servicio. Si desea reprogramar, notifíquenos durante la misma semana o tan pronto como sea posible para que podamos reprogramar su sesión a la próxima fecha disponible y brindar este tiempo a otro cliente. * Esto es aplicable solo en el caso de aplazamientos no relacionados con el clima y que no sean de emergencia.

3. CLIMA INCLEMENTE. ¡Simplemente reprogramaremos su sesión para la próxima fecha disponible! También se puede organizar una ubicación interior adecuada.

4. TIEMPO. Llegue a tiempo a su sesión vestido y listo para comenzar o según los detalles discutidos anteriormente. Hay una ventana de tiempo asignada para su sesión de fotos que comienza a la hora especificada, por lo que el tiempo adicional de preparación reducirá el tiempo que podemos dedicar a tomar fotos. Si llega más de 1 hora tarde, esto generará una tarifa de $30.00 adicionales.

5. SESIÓN DE FOTOS. Las cámaras de cualquier tipo no están permitidas en nuestras sesiones de fotos.

6. ASISTENCIA. La asistencia a las sesiones de fotos está limitada a las personas fotografiadas. No se permitirá más de 1 persona adicional en la sesión de fotos. Tener personas adicionales presentes puede distraer tanto al fotógrafo como a los que están fotografiando.

7. PRODUCTOS. Las fotos se publicarán en una galería en línea donde el cliente puede seleccionar sus favoritos, escribir sugerencias y descargar fotos en otros dispositivos.

8. COPYRIGHT. Todas las imágenes proporcionadas por Carlos Javier, ya sean digitales o impresas, no pueden reproducirse de ninguna manera. Esto incluye capturas de pantalla de pruebas. Hacerlo constituye una infracción de derechos de autor y es punible por ley.

9. USO NO COMERCIAL. Las fotos de Carlos Javier están estrictamente disponibles para fines editoriales. Se requieren contratos especiales con fotógrafos profesionales y / o versiones de modelos para cualquier foto destinada a fines comerciales.

10. USO DE FOTOGRAFÍAS. Nunca altere el contenido o el significado de una fotografía. Para proteger la identidad de las poblaciones vulnerables en riesgo de represalias, violencia o rechazo en sus comunidades como resultado de contar su historia, puede ser apropiado omitir información detallada sobre el contenido de la foto. Deben tenerse debidamente en cuenta los derechos individuales y la privacidad de las personas fotografiadas, se deben observar los principios básicos de la dignidad humana. En todas las fotos y publicaciones en redes sociales relacionadas con mi trabajo, mi sitio web y yo debemos ser acreditados.
